These Terms & Conditions ("Terms") govern your use of the marketing pages operated by Exceptional Dentistry ("we," "us," or "our") related to the Exceptional Savings Plan, including:

(collectively, the "Site"). By accessing or using the Site, or by submitting a form on the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. The Exceptional Savings Plan Is Not Insurance

2. Eligibility

You must be at least 18 years old to submit a form on this Site or to enroll in the Exceptional Savings Plan on your own behalf. A parent or legal guardian may enroll a minor as a covered member of a Family or Child plan.

3. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

• Submit false, misleading, or fraudulent information through our forms
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems
• Use any automated system (bot, scraper, spider) to access the Site without our prior written consent
• Use the Site to transmit any harmful code or malicious software

4. Communications Consent

By submitting the enrollment form on this Site, you expressly consent to be contacted by Exceptional Dentistry by phone call, text message (SMS), and email regarding the Exceptional Savings Plan and related services, including through the use of automated dialing or messaging technology. Consent to receive such communications is not required as a condition of enrollment. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, and may opt out of calls or emails by contacting us using the information in Section 13. See our Privacy Policy for further detail.

5. Intellectual Property

All content on the Site — including text, graphics, logos, images, and video — is owned by or licensed to Exceptional Dentistry and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.

6. Third-Party Services

The Site incorporates services provided by third parties, including Vimeo (video hosting), Elfsight (review display), GoHighLevel/NerdsBoost (form processing), Meta, and Google (advertising and analytics). Your use of features powered by these third parties is also subject to their respective terms of service. We are not responsible for the availability, accuracy, or practices of these third-party services.

7. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the fullest extent permitted by law, Exceptional Dentistry and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed the amount, if any, you paid to us in connection with the Exceptional Savings Plan.

9. Indemnification

You agree to indemnify and hold harmless Exceptional Dentistry and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

11. Changes to These Terms

We may revise these Terms from time to time. Changes are effective when posted on this page, with the "Last updated" date revised accordingly. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

12. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. These Terms, together with our Privacy Policy and your signed Membership Enrollment Agreement (if applicable), constitute the entire agreement between you and Exceptional Dentistry regarding the Site.
